Fiscal year 2020 is upon us, and as you may be aware the October 2019 Visa Bulletin has opened the possibility for filing adjustment of status applications for certain EB-5 clients. Individuals born in China with an approved I-526 with a priority date of January 1, 2015 or earlier, and all others with an approved I-526 may file an application for adjustment of status starting October 1st if they are in the United States in lawful status. EB-5 Applicants with certain non-immigrant visas should be aware of potential drawbacks to the I-485 process should they choose to pursue to adjustment of status.
